Copyright and DMCA Policy

Re Embroidery ("Re Embroidery," "we," "us," or "our"), respects intellectual property rights and expects users of reembroidery.com (the "Site") to do the same. This Copyright and DMCA Policy explains how we protect our designs and how to submit a notice of alleged copyright infringement under the Digital Millennium Copyright Act, 17 U.S.C. § 512 (the "DMCA").

1. Our copyrights

All embroidery design files ("Designs") sold or distributed on the Site are original creative works of Re Embroidery (or our licensors). Each Design is protected by United States copyright law (17 U.S.C. § 101 et seq.) and international copyright treaties (Berne Convention, WIPO Copyright Treaty). Use of Designs is governed by our License and Commercial Use page.

2. What you may do

  • Stitch the Design onto fabric or other physical materials using your own equipment
  • Sell finished embroidered items, subject to the limits in the License
  • Edit colors, resize, and adjust within your embroidery software for your own use

3. What you may not do

  • Resell, share, gift, or redistribute Design files in any digital format
  • Upload Designs to marketplaces, file-sharing sites, pattern aggregators, or social media for download
  • Bundle Designs into a design pack or product-of-the-month sold under your name
  • Claim authorship of the Designs or remove copyright notices
  • Use Designs to train AI or machine-learning systems
  • Re-digitize Designs to create a derivative file you sell as your own

4. Notice of claimed infringement (DMCA takedown)

If you believe content on the Site infringes a copyright you own or control, you may submit a written notice that complies with 17 U.S.C. § 512(c)(3). To be effective, the notice must include all of the following:

  1. A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed
  2. Identification of the copyrighted work claimed to have been infringed (or, if multiple works at a single online site are covered, a representative list of such works)
  3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity, with information reasonably sufficient to permit us to locate the material (URL, screenshot, product handle)
  4. Information reasonably sufficient to permit us to contact you (full name, mailing address, telephone, email)
  5. A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law
  6. A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the owner or are authorized to act on behalf of the owner of the exclusive right that is allegedly infringed

5. False notices

Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing, or that material was removed by mistake or misidentification, may be liable for damages, including costs and attorney fees. Submit notices in good faith and with care.

6. Our response to notices

Upon receipt of a notice that complies with the requirements above, we will:

  1. Acknowledge receipt within 5 business days
  2. Promptly remove or disable access to the allegedly infringing material
  3. Notify the user who posted or uploaded the material (where applicable)
  4. Take reasonable steps to address repeat infringement (see Section 8)

7. Counter-notice (17 U.S.C. § 512(g))

If your content was removed and you believe the removal was the result of mistake or misidentification, you may submit a written counter-notice that includes:

  1. Your physical or electronic signature
  2. Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed
  3. A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification
  4. Your full name, mailing address, telephone, and email
  5. A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located, or, if outside the United States, for any judicial district in which Re Embroidery may be found, and that you will accept service of process from the person who provided the original notice or that person’s agent

Upon receipt of a valid counter-notice, we will forward it to the original complainant and inform them that we may restore the removed material in 10 to 14 business days unless they file an action seeking a court order against the user.

8. Repeat infringer policy

In accordance with 17 U.S.C. § 512(i), we have adopted and reasonably implemented a policy of terminating, in appropriate circumstances, accounts of users who are repeat infringers. We may also terminate accounts on a single instance of egregious infringement (e.g., mass redistribution of our Designs).

9. Reporting unauthorized re-uploads of our Designs

If you have seen our Designs uploaded to another site, marketplace, file-share, or social platform without authorization, please report it to copyright@reembroidery.com with:

  • The infringing URL
  • Screenshots showing the unauthorized listing or upload
  • Any usernames or seller names involved

We pursue takedowns directly with the host platform and, where warranted, with legal action.

10. Trademark complaints

For complaints involving trademark infringement (rather than copyright), email legal@reembroidery.com with the registered trademark, the offending use, and your contact information.

11. Updates

We may update this policy. The "Effective date" reflects the most recent revision.
